The state is Arkansas. The law is that if you are found not guility of the refusal by the trial judge then immediatley the DMV gives you back your license and there is no record of the suspension on your driving record. The DMV for the most part is just a rubber stamp in my state. In fact the lawyer said don't even show up and fight it at the DMV. They use the PR and then suspend the license. That is just for Arkansas is all I know.

Im understand what the fruit of the poisonous treee is..I think your "killing the president" example is a bit extreem...sure if the confession was illegally obtained that can be supressed but that doesnt mean that all other evidence that existed prior to the arrest is thrown out..I didnt know that the courts "trump" the DMV in AR in DUI's in most states they are seperate proceedings and not dependant upon each other...interesting.

I am in Arkansas. The charges are different but the criminal charge trumps the DMV. I am only talking about an illegal arrest. You can admit to killing the president but anything you say or admit to after an illegal arrest is like it never happened. Therefore the refusal never happened.

You are correct. However what you must realize that most don't. It does not matter what happens after an illegal arrest. It is called fruit of the poisonous tree. That means that anything you did, said, ect,... after the illegal arrest is suppressed. I agree that if you beat the traditional DWI and then don't take the BAC at the station that is a separate offense. I am talking about an illegal arrest on the front end.

While this is true in many states, regardless of the result of the criminal trial your refusal to submit to chemical screening/testing will automatically result in administrative revokation of your license through the DMV. Did it happen in your state/case?

Funny how he declined medical attention when offered by the police after the arrest if he was really in so much pain or had a broken arm...he was being a drunk crybaby..not an injured man. The cuffing technique was in reaction to this jackass'es behavior. How often do you have to deal with drunks, not just verbally but physically as well..you sound like you dont have the first damn clue.

He clearly stated that his arm was hurting (maybe even broken) and the officer even mentioned this during the test, yet they took no care in handcuffing him. Drunk or not, this was unnecessary. I think it's interesting that nobody's even addressed this in comments.

Another thing is that is actually shows you have your senses about you if you refuse to take the tests. I would argue only a drunk would be dumb enough to think anything short of blowing into a breathlizer even if God himself came down and helped you with the road side tests. Back in college I got pulled over and they wanted me to do the tests. I said can I just blow in the machine to get this over with and blew 0.00 but knew that was what was going to happen anyway so just got it over

I did not mean you would fail everytime because you could not do the tests. I meant they are going to say you failed. Me and a friend were drunk and riding with our sober (zero) drinks driver. He got pulled over. They put him through 15 min of tests and then said he flunked and he needed to blow in the field breathlizer. Of course 0.00. The cop smelled alachol on us so he was bound and determined that our driver was drinking also.

Your absoulutely wrong that you will flunk every time. the standardized field sobriety tests are very easy to pass if you are sober. They are also not the only things that establish probable cause to arrest a DUI suspect. Sure falling down hammered is an easier arrest there are other observations in the field that lead to many an arrest

I doubt it. Mileage and time are recorded when the officer arrives at the precinct. You can actually hear the officer report this over the radio as he is pulling up at the precinct in the second video. This guy was so emotionally unstable at the time (because he was drunk and because of the family problems he was having leading up to this) that he probably did it to himself either accidentally or purposely out of desperation in an attempt to skirt the charges.

LOL yeah I don't know what i'm talking about. I refused everything including the test at the station. Officer said I smelled like alachol. My lawyer asked if smelling like alachol was against the law. Judge said no P.C. to arrest me for other than speeding. I simply in a polite manner refused all tests at the scene. there was no evidence of DWI, since no DWI evidence the arrest and the refusal at the station were tossed. No law against refusing at the scene. Yeah but i have no clue.

You have no clue what you are talking about. If they smell alcohol and you refuse the test then they can take you to jail and they will give you a breath test which you will fail and you will get charged with a dui.

NEVER, NEVER, agree to field sobriety tests. You have no legal obligation. You will flunk everytime no matter what. You are in a no win situation. The only required test is at the station on the breath test. However if you take no field tests then there is no probable cause to even arrest. Unless you are just falling down hammered drunk. Other than that you just smell like alachol which is not against the law.
